Referral Program Terms & Conditions

These Referral Program Terms & Conditions (“Terms”) govern participation in the referral program operated by Michael Shea Financial Services Pty Ltd (“MSFS”, “we”, “us”, “our”).

By applying to join, accessing, or participating in the referral program (“Program”), you (“Referral Partner”, “you”, “your”) agree to be bound by these Terms.

1. Program Overview

The Program enables approved referral partners to introduce prospective clients to Michael Shea Financial Services Pty Ltd for consideration of finance solutions, including (but not limited to) home loans, refinancing, personal loans, vehicle finance, and commercial finance.

Referral Partners may be eligible to receive a referral commission where an introduced referral proceeds to settlement, subject to these Terms.

2. Application and Acceptance

2.1 Application Required
Registration on the Program website constitutes an application to become a Referral Partner.

2.2 Approval Required
Submission of an application does not automatically result in acceptance. All Referral Partners must be reviewed and formally approved by MSFS before they are eligible to submit referrals or receive referral commissions.

2.3 Discretion to Accept or Decline
MSFS reserves the right to accept, decline, suspend, or terminate any Referral Partner’s participation in the Program at its discretion.

3. Nature of the Relationship

3.1 Independent Commercial Relationship
Referral Partners participate in the Program as independent parties operating under a referral arrangement.

3.2 No Employment Relationship
Nothing in these Terms creates an employment relationship between the Referral Partner and MSFS.

3.3 No Authority to Bind
Referral Partners are not authorised to bind MSFS, make representations on its behalf, or enter into contracts on its behalf.

3.4 Credit Advice and Licensing
Referral Partners are not authorised credit representatives of MSFS and must not provide credit assistance or regulated financial advice.

4. Definition of a Qualified Lead

A Qualified Lead is a person introduced by a Referral Partner who:

  • Has a genuine or emerging interest in exploring finance options (including purchasing, refinancing, borrowing, or restructuring existing finance);

  • Has explicitly agreed to be contacted by MSFS;

  • Is contactable and provides accurate contact details;

  • Is willing to engage in a good-faith discussion with MSFS regarding their finance needs; and

  • Is not a fabricated, recycled, duplicated, or non-consensual referral.

A referral may still be considered a Qualified Lead even if the individual is:

  • Exploring options;

  • Seeking general information;

  • Requesting borrowing estimates; or

  • Speaking with other lenders or brokers at the time of referral.

5. What Is Not a Qualified Lead

The following do not constitute Qualified Leads:

  • Individuals who have not agreed to be contacted by MSFS;

  • Fake, misleading, duplicated, or recycled leads;

  • Individuals submitted without their knowledge or consent;

  • Leads generated through spam, automated systems, or deceptive practices;

  • Individuals who are uncontactable after reasonable attempts.

6. Referral Partner Obligations

Referral Partners must:

  • Only refer individuals with whom they have a genuine connection or relationship, or who have otherwise provided informed consent;

  • Ensure that all referral information submitted is accurate and truthful;

  • Act professionally and in good faith at all times;

  • Comply with all applicable Australian laws, including privacy and consumer protection laws.

7. Prohibited Conduct

Referral Partners must not:

  • Submit referrals without the individual’s prior consent;

  • Cold call, spam, or mass-market finance services on behalf of MSFS;

  • Provide credit advice, product recommendations, or lender-specific guidance;

  • Quote interest rates or guarantee borrowing outcomes;

  • Represent themselves as a mortgage broker or as an employee or authorised representative of MSFS;

  • Engage in conduct that may mislead consumers or damage the reputation of MSFS.

8. Commission and Payment

8.1 Settlement-Based Commission
Referral commissions are payable only where a referral introduced by the Referral Partner proceeds to settlement through MSFS.

8.2 No Guarantee of Commission
If a referral does not proceed to settlement, no commission is payable, regardless of time spent or application progress.

8.3 Payment Terms
Commission structure, amounts, and payment timing will be communicated separately and may be subject to administrative or compliance requirements.

9. Privacy and Consent

9.1 Consent Requirement
Referral Partners must obtain clear and informed consent from each referred individual before submitting their details.

9.2 Privacy Compliance
All personal information must be handled in accordance with applicable privacy legislation and MSFS’s Privacy Policy.

10. Suspension and Termination

MSFS may suspend or terminate a Referral Partner’s participation in the Program if the Referral Partner:

  • Breaches these Terms;

  • Submits non-consensual or misleading referrals;

  • Engages in prohibited conduct; or

  • Acts in a manner inconsistent with the objectives or reputation of the Program.

Termination does not entitle the Referral Partner to future commissions.

11. Limitation of Liability

To the extent permitted by law, MSFS is not liable for indirect, incidental, or consequential loss arising from participation in the Program.

12. Changes to These Terms

MSFS may update these Terms from time to time. Continued participation in the Program constitutes acceptance of any updated Terms.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia, and the parties submit to the exclusive jurisdiction of its courts.

By applying to join or participating in the Michael Shea Financial Services Pty Ltd Referral Program, you confirm that you have read, understood, and agree to these Terms & Conditions.
